Judge could drop charges against Weinstein

In the months after The New York Times and The New Yorker began publishing stories about Weinstein's interactions with women, activists pressured Vance to bring charges as dozens of people came forward with claims of sexual misconduct against him.

Weinstein is expected in a NY courtroom Thursday for what will be a pivotal pretrial hearing in his criminal case.

Weinstein, who faces a up to life in prison if convicted of the five charges against him, has denied having nonconsensual sex with anyone following accusations by more than 70 women, mostly young actresses and other women employed in the movie business, of sexual misconduct, including rape, going back decades.

Disgraced movie producer indicted on two counts of rape and one count of criminal sex act; Laura Ingle reports from New York City. Weinstein was hoping to have the charges in his criminal case dismissed.

The next hearing is set for March 7.

Attorney Gloria Allred, who represents one of the alleged victims, said she is satisfied that the case will move to a pretrial hearing, adding that the case against Weinstein is strong.

A friend of Evans said she had heard her say that she had willingly engaged in oral sex with Weinstein to secure a movie role.

Prosecutors also apparently failed to disclose to the defense affectionate text messages Haleyi sent to Weinstein after the alleged assault, which would have introduced a notion of doubt about the forced nature of the encounter.

"I still believe the charges need to be dismissed", said Brafman, who had argued that the case should be tossed out because of misconduct by police and prosecutors.

"Frankly, we are relieved that Harvey Weinstein failed in his efforts to avoid accountability for his actions, and we are very happy that none of the charges were dismissed". Actresses Amber Tamblyn and Jennifer Esposito were by Tomei's side as they took a victory lap outside the courthouse.

Prosecutors nevertheless want the case to continue and reject Brafman's motion that the process is beyond fix.

DiGaudio allegedly told the witness last February that "less is more" but kept prosecutors in the dark. "If these women testify strongly on the witness stand, Weinstein will lose".

Weinstein's lawyers say the case has devolved into chaos and was "irreparably tainted" by Det Nicholas DiGaudio's alleged interference with a witness and an accuser.

"The only reasonably prudent decision would be to stop this chaos now", Brafman said in a court filing.

Prosecutors say there is "ample evidence" to move forward. "We remain confident, despite the court's ruling today, that ultimately at a trial of this case Mr Weinstein will be completely exonerated", Brafman said.
